Terms and Conditions
Please read through the Terms and Conditions thoroughly before enrolling. When enrolling as a client of Movementality Pilates, you agree to the terms and conditions as laid out on the Movementality website, movementality.com.au and as provided on our booking site.
General Terms and Conditions
Payment must be made prior to booking. To book into a class you must either have pre-purchased sessions in your account or pay at the time of booking in the studio.
Cancellations made within 12 hours prior to the class start time will forfeit that session. No-shows and absences will forfeit that session (see Late Cancellation Policy below).
The Client accepts that the open class timetable is subject to change without notice, and some classes may be cancelled on occasion.
The Client accepts that rostered Instructors may change on occasion with little or no notice to the client. Movementality Pilates will endeavour to let you know as soon as changes are made where possible.
The Client accepts that regularly timetabled classes may not be available during public holidays.
Sessions are non-refundable. Sessions may only be extended if you are injured, in which case we may request a medical certificate. Extensions due to medical reasons must be requested before the expiry date. Sessions may be transferred, subject to approval from the owners.
Owners and/or practitioners reserve the right to restrict clients to a particular class type for safety reasons; and owners and/or practitioners reserve the right to turn clients away if they do not have the correct medical clearance, or if we feel they are unsafe to participate in a session.
Memberships
1. GENERAL TERMS
1.a. All Memberships are open ended and can be cancelled at any time by contacting the studio and providing 1 weeks written notice.
1.b. All Memberships operate on a weekly or monthly autopay schedule from the credit card or bank account stored in Stripe or EziDebit via Bookings Essential (a secure system). Payment will continue unless notified (see Termination Policy below).
1.c. Memberships will continue with scheduled autopays unless Movementality is notified of a termination request in writing (see Termination Policy below).
1.d. These classes do not roll over beyond their expiration unless otherwise approved by the owners.
1.e. It is the Client’s responsibility to book their own classes using the Movementality website or app.
1.f. Memberships may be subject to price increase, but will be communicated in writing 30 days prior to any change.
2. MEMBERSHIP SUSPENSIONS
2.a. At least one (1) weeks written notice is required for membership pauses / suspensions. This ensures that the correct measures are put in place to cease credit card payments that are scheduled for the given period.
2.b. Suspensions are for a minimum of one (1) weeks, maximum of twelve (12) weeks per year. Please email requests to info@movementality.com.au.
2.c. The Suspension period will freeze payments for the nominated amount of days.
2.d. The client will cease any regular bookings if pause extendeds beyond 2 weeks, or with multiple pauses per year. This will be at the owners discretion.
3. MEMBERSHIP TERMINATION POLICY
3.a. Movementality requires at least one (1) weeks written notice to terminate membership. Please email request to info@movementality.com.au
3.b. In the case of long term or permanent injury or illness that prevents the use of our services, immediate membership termination will be permitted. Termination will take effect from the date we receive written confirmation with a medical certificate or equivalent proof of medical event.
3.c. Movementality may terminate a membership without notice for inappropriate, offensive or illegal behaviour, as determined by us, which occurs on our premises or is directed at our staff or other members.
3.d. Once a membership is terminated, any unused sessions can be used until their expiration. Any remaining sessions beyond expiration will be forfeit.
4. DIRECT DEBITS
4.a. By agreeing to a Membership direct debit, the Client acknowledges that Ezidebit Pty Ltd has been used by Movementality to collect the direct debit fees, as assigned by Bookings Essential booking system.
4.b. It is the Client’s responsibility to book their own classes using the Movementality website.
4.c. It is the Client’s responsibility to ensure there is sufficient funds in the nominated account by the due date to enable the weekly direct debit to be processed.
4.d. If the clients bank/credit details change, the Client will notify Movementality in advance to avoid delays in payment processing. Any late payment fees are the liability of the client.
4.e. If there are insufficient funds, the Client agrees that Movementality nor Ezi Debit will not be held responsible for any fees and charges that may be charged to the Client due to the Client’s financial position. Ezidebit will autmatically charge a $10.00 fee to the Client’s nominated account if the payment is dishonoured. Repeated failed payments will result in membership cancellation.
4.f. If the Client’s account becomes in arrears, they give permission for Ezidebit to debit the outstanding balance to bring their account back up to date.
4.g. If the Client’s account continues to stay in arrears, they understand that Movementality may cancel my future scheduled classes until my account is rectified.
4.h. All memberships are set to automatically renew weekly or monthly until otherwise advised.
Late Cancellation Policy
Our cancellation policy is in place to ensure everyone has a chance to attend class. Cancellations are the responsibility of the person booking the class.
All session cancellations can be made via our website (log in to your account via the book now button above), email, or phone. We do not accept cancellations for these session in person or via social media.
A ‘Late Cancel’ is defined as a cancellation within a 12 hour window of the session start time. A ‘No Show” is defined as a client not arriving to a session that has been pre-booked, and is considered the same as a late cancellation.
Where a client is a Late Cancel or No Show to a session, that session is forfeit. Clients have the option to “buy-back” that session for a reduced rate within 7 days. The “buy-back” fees are as follows:
Private Sessions - Pilates, SMT, FN (1:1) $80
Duet sessions (1:2) $40
Semi-private Pilates (1:4) $30
If no prepaid pack is available, fees are charged to your account and must be paid prior to commencing your next session.
Where possible, Movementality may offer to move the cancelled session within the expiration date, if it does not impact future debits or payments, or impact fellow clients from accessing sessions. This will be at the discretion of the owner/practitioner.
Session expirations
All sessions have double the lenth of the debit to utilise e.g. a weekly debit of 1 session will have 2 weeks to be utilise; a monthly debit has 2 months to use the sessions. This is designed to allow for when clients miss one week to double up the next.
Due to the flexibility offered, there are no extensions beyond the initial expiry date. Exceptions to this include medical events or family bereavements.
Work, social, and pet-related events are not considered for extension. Family events may be considered but are at the discretion of the owners.
Sessions are only valid while a membership is active. All unused sessions with be forfeit in a membership is cancelled.
